Sambad.com (including all subdomains such as lottery.sambad.com) respects the intellectual property rights of others and expects its users to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how we handle copyright infringement claims on our Site. If any content on our Site is believed to infringe your copyright, you may notify us as described below so we can review and address the issue promptly.

This Policy applies to all services and content provided on Sambad.com and its subdomains. It is part of our broader commitment to lawful content use. Designated DMCA Agent

In accordance with the DMCA, we have designated the following agent to receive notifications of claimed copyright infringement on our Site:

Note: While we follow the DMCA notice-and-takedown process, our designated DMCA Agent is not currently registered with the U.S. Copyright Office. You can still send us DMCA notices at the email above, and we will respond in good faith to address any valid complaints.

Copyright Infringement Notification Procedure

If you believe that material on our Site infringes your copyright, please send us a DMCA takedown notice. Your notice should be a written communication (email is preferred) that includes all of the following:

  • Identification of the copyrighted work that you claim has been infringed. If multiple works are involved, you may provide a representative list of such works.
  • Identification of the allegedly infringing material on our Site, with information reasonably sufficient to allow us to locate the material. Please include specific URLs or pages where the material is found.
  • Contact information for the complaining party: your full name, mailing address, telephone number, and email address.
  • A statement of good faith belief: a sentence confirming that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy and authority statement: a sentence certifying that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf.
  • Signature: a physical or electronic signature of the copyright owner or the person authorized to act on their behalf. You may type your full name as an electronic signature.

Please ensure all of the above information is included; otherwise, we may not be able to process your request. You should send your infringement notice to our designated DMCA Agent at [email protected] (please put “DMCA Notice” in the subject line for clarity). We prefer email notice for fastest response. If you send a physical notice (for example, by mail or courier), processing may be delayed.

Action Upon Receipt of a Valid Notice

When we receive a valid copyright infringement notification containing all the required information above, we will take prompt action. This includes:

  • Content Removal or Disabling: We will remove the allegedly infringing content from our Site or disable access to it. This may involve taking down specific posts, images, or other material that is claimed to be infringing.
  • Notification to the User (If Applicable): If the allegedly infringing content was posted by a user of our Site (for example, a comment or user-submitted material) and we have contact information for that user, we will make a good-faith effort to notify them of the removal. We will inform the user that we removed the content due to a DMCA complaint and provide information about the notice. We may also provide the user with a copy of the DMCA notice, including the complaining party’s name and email (as required by the DMCA).

Our goal is to address infringement claims expeditiously and fairly. The content will remain offline unless and until the issue is resolved (for example, through a valid counter-notification, as described below, or by agreement of the parties).

Counter-Notification Procedure

If you are a user of our Site and you believe that content you posted was removed or disabled by mistake or misidentification (for instance, you believe your content was not infringing or that you have permission from the copyright owner), you have the right to submit a counter-notice under the DMCA. A counter-notification must be a written communication to our DMCA Agent and should include the following:

  • Your contact information: Your name, address, telephone number, and email address.
  • Identification of the material removed: A description of the content that was removed or disabled and the location (URL/page) where it appeared before removal. Please be as specific as possible (e.g., “The comment I posted on [date] under the article [article title], which was removed”).
  • Good faith statement: A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification of the material to be removed. For example, you might state that you believe you have rights to use the content, or that the content was incorrectly identified as infringing.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside of the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person (or their agent) who provided the original DMCA infringement notice.
  • Signature: Your physical or electronic signature. Just like with the original notice, typing your full name at the end of the counter-notice can serve as your electronic signature.

After we receive a valid counter-notification, we will review it and forward a copy to the original complaining party (the person who sent the DMCA takedown notice). DMCA Process Following Counter-Notice: Once we forward your counter-notice to the complainant, the DMCA provides that we may restore the removed content in 10 business days (at least) and no later than 14 business days after receiving the counter-notice, unless our DMCA Agent first receives notice that the original complainant has filed a court action seeking an order to prevent the user from re-posting the removed content. This means:

  • If the complaining party does not inform us within that period that they have initiated legal action to restrain the allegedly infringing activity, we may, in our discretion, replace or restore the removed content after the 10-14 business day waiting period.
  • If the complaining party does notify us that they have filed a lawsuit seeking a court order against the user, we will not restore the content unless the matter is resolved in the user’s favor (for example, by court order, settlement, or withdrawal of the complaint).

Please note that by submitting a counter-notice, you are agreeing to the legal conditions listed above (consent to jurisdiction and service of process). Do not submit a counter-notification if you are unsure of your rights to the content – you may want to consult an attorney before doing so. Filing a false counter-notice could have legal consequences.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Sambad.com maintains a policy to terminate or restrict users who are repeat infringers. If a particular user or account repeatedly posts content that infringes others’ copyrights, or repeatedly violates our content policies, we reserve the right to take appropriate actions, including:

  • Content Posting Restrictions or Bans: We may disable the user’s ability to post new content (for example, disable commenting privileges) either temporarily or permanently.
  • Account Termination: If the user has an account on our Site, we may terminate the account entirely in the case of repeat infringements.
  • Access Blocks: For users without accounts (e.g., posting via IP), we may block their IP address or implement other technical measures to prevent further infringements.

We generally define a “repeat infringer” as any user who has been the subject of multiple (e.g., two or more) valid DMCA takedown notices or other confirmed copyright infringement complaints. However, we reserve the right to act on a single infringement incident in severe cases. Our goal is to foster respect for intellectual property rights and to comply with the DMCA’s requirements for service providers.

False Claims and Section 512(f) Notice

Important – Liability for Misrepresentation: The DMCA requires that you only submit notices and counter-notices in good faith. Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing (or, in the case of a counter-notice, that material was removed or disabled by mistake or misidentification) may be held liable for damages, including costs and attorneys’ fees. In plain terms, this means that if you knowingly send us a false DMCA claim – whether to get content removed that you don’t actually own, or a false counter-notice to get infringing content put back – you could face legal consequences. We take abuse of the DMCA process seriously. Fraudulent or bad-faith notices will be ignored or rejected, and may also be reported to the appropriate authorities.

DMCA.com Protection and Monitoring

To protect our own original content and help prevent copyright violations, Sambad.com utilizes services provided by DMCA.com. You may notice a DMCA.com “Protected” badge or logo displayed on our Site. This indicates that our website’s content is enrolled in DMCA.com’s content protection program. DMCA.com’s services include automated protection systems that scan for and flag potential instances of our content being used without authorization on other websites. These tools also assist us in monitoring content on our own Site for potential copyright issues.

Automated Flagging of Infringing Content: If DMCA.com’s monitoring systems or other automated protections identify content on our Site that might be infringing someone else’s copyright, or if they detect our content being copied elsewhere, we will review the situation promptly. We may proactively remove or disable content flagged as infringing even before receiving a formal DMCA notice, as part of our commitment to uphold copyright laws and maintain the integrity of our Site. All removals or actions taken using these automated alerts will still be consistent with the processes outlined in this Policy (including notice to users and the option of counter-notice, when applicable).

By using our Site, you acknowledge and understand that we employ these third-party copyright protection services to safeguard content. These measures are in place both to protect the rights of content owners and to protect our website’s original materials from unauthorized use. They do not replace the DMCA notification process but rather complement it by adding an extra layer of vigilance against potential copyright infringement.
